Terms and Conditions

These Terms and Conditions ("Terms") apply to all applications, software, digital products, and services developed and provided by IsmailApps LLC ("Service Provider", "we", "us", or "our"), including the website https://ismailapps.store and our portfolio of native applications.

By downloading, accessing, purchasing, subscribing to, or using any of our applications or services, you agree to these Terms. If you do not agree with these Terms, you should not use our applications or services.

1. About Our Applications and Services

IsmailApps develops and distributes software applications, digital tools, and utility solutions designed to enhance user productivity across macOS, desktop, and mobile platforms. Our products and services are provided for informational, productivity, and utility purposes.

The Application may use third-party artificial intelligence services and other third-party technologies to generate or process content.

AI-generated information is provided for general informational and assistance purposes and should not be considered a substitute for professional, legal, medical, financial, or other specialized advice.

2. AI-Generated Content

Certain content provided through the Application is generated using artificial intelligence.

Artificial intelligence systems can produce inaccurate, incomplete, outdated, misleading, or inappropriate information. The Service Provider does not guarantee that AI-generated responses will always be accurate, complete, reliable, or suitable for a particular purpose.

Users are responsible for independently reviewing and verifying important information before relying upon it.

The Service Provider is not responsible for decisions or actions taken based on AI-generated content.

3. User Content

Users may be able to submit questions, prompts, text, images, documents, or other content (“User Content”) to use certain features of the Application.

You are responsible for the content you submit and must ensure that you have the necessary rights and permissions to use and submit such content.

You must not submit content that:

• Violates applicable laws or regulations;
• Infringes intellectual property or other rights of another person;
• Contains unlawful, abusive, fraudulent, malicious, or harmful material;
• Attempts to interfere with, exploit, reverse engineer, or compromise the Application or its supporting services; or
• Is otherwise prohibited by these Terms.

Certain User Content may be transmitted to third-party service providers when necessary to provide requested functionality. Such processing is subject to our Privacy Policy and, where applicable, the policies of the relevant third-party provider.

4. Third-Party Services

The Application may depend on third-party services, including artificial intelligence providers, cloud infrastructure, application marketplaces, subscription systems, and other technology providers.

The availability and operation of certain Application features may therefore depend on these third-party services.

The Service Provider does not control all aspects of third-party services and cannot guarantee their continuous availability, accuracy, performance, or functionality.

Third-party services may be governed by their own terms, policies, and privacy practices.

5. Privacy

Your use of the Application is also subject to our Privacy Policy.

The Service Provider does not directly collect or store users’ personal data on its own servers through the Application except where specifically disclosed.

Certain information or content may be processed by third-party services when required to provide functionality requested by the user. Please review the Privacy Policy for additional information regarding data processing and third-party services.

6. Freemium Features

The Application may provide certain features free of charge while requiring payment or a subscription to access premium functionality.

The availability, limitations, usage allowances, and functionality of free and premium features may change over time.

We reserve the right to add, modify, restrict, or discontinue features where reasonably necessary to improve, maintain, or operate the Application.

7. Subscriptions and In-App Purchases

The Application may offer auto-renewable subscriptions or other in-app purchases.

Where purchases are made through the Apple App Store, payment will be charged to your Apple ID account according to Apple’s applicable payment terms.

Subscription prices, durations, trial periods, and other purchase information will be displayed within the Application or on the applicable App Store purchase screen before you complete a purchase.

Unless otherwise stated, an auto-renewable subscription will automatically renew unless it is cancelled before the end of the current subscription period in accordance with the applicable App Store requirements.

You can manage or cancel subscriptions through your Apple ID Account Settings on your device.

Pricing and subscription terms may be updated from time to time. Where required by applicable App Store rules, you will be notified of price changes in advance.

8. Billing and Cancellations

All payment transactions, billing inquiries, and subscription management are handled directly by the Apple App Store (or other marketplace provider through which you downloaded the Application).

Because the Service Provider does not directly process payments or manage App Store accounts, the Service Provider cannot directly issue refunds, pause subscriptions, or modify billing details for App Store purchases.

If you wish to request a refund, you must do so through Apple’s refund request process in accordance with Apple’s policies.

9. User Responsibilities

You agree to use the Application in compliance with these Terms, applicable laws, and relevant third-party terms (including App Store rules and guidelines).

You are responsible for:

Maintaining the security of your device;

Ensuring you have internet access required to use online features of the Application; and

The accuracy and legality of any content you submit through the Application.

10. Prohibited Activities

You agree that you will not:

• Gain unauthorized access to the Application or associated systems;
• Circumvent subscription, payment, usage, or feature restrictions;
• Abuse or excessively automate requests to the Application;
• Reverse engineer, modify, decompile, or interfere with the Application except where permitted by applicable law;
• Use automated systems, bots, scripts, or similar mechanisms to exploit the Application;
• Introduce malware or other harmful code;
• Interfere with the Application’s infrastructure or third-party services; or
• Use the Application for unlawful purposes.

We reserve the right to restrict or terminate access where we reasonably determine that the Application is being abused or used in violation of these Terms.

11. Intellectual Property

The Application, including its design, software, branding, graphics, interfaces, and original content, is owned by or licensed to IsmailApps LLC and is protected by applicable intellectual property laws.

These Terms do not grant users ownership of the Application or any intellectual property belonging to the Service Provider.

Users receive a limited, personal, non-exclusive, non-transferable, and revocable right to use the Application in accordance with these Terms.

12. Availability and Changes to the Service

We aim to keep the Application operational but do not guarantee uninterrupted or error-free availability.

The Application or individual features may occasionally be unavailable due to maintenance, technical problems, third-party service outages, upgrades, security requirements, or circumstances outside our reasonable control.

We may update, modify, replace, suspend, or discontinue features of the Application when reasonably necessary.

13. Disclaimer of Warranties

To the maximum extent permitted by applicable law, the Application and its content are provided on an “AS IS” and “AS AVAILABLE” basis.

The Service Provider does not warrant that:

• The Application will always be available or error-free;
• AI-generated content will always be accurate or complete;
• The Application will meet every user’s individual requirements;
• Third-party services will remain available; or
• Every defect or technical issue will be corrected immediately.

Nothing in these Terms excludes warranties or rights that cannot legally be excluded under applicable consumer protection laws.

14. Limitation of Liability

To the maximum extent permitted by applicable law, IsmailApps LLC will not be liable for indirect, incidental, special, consequential, or similar damages resulting from the use of, inability to use, or reliance upon the Application or AI-generated content.

The Service Provider is not responsible for losses resulting from inaccurate AI-generated information, third-party service failures, network interruptions, device problems, or misuse of the Application.

Nothing in these Terms limits liability where such limitation is prohibited by applicable law.

15. Termination

You may stop using the Application at any time.

The Service Provider may suspend or terminate access to the Application where reasonably necessary, including in cases involving abuse, fraud, security threats, unlawful activity, violation of these Terms, or attempts to circumvent Application restrictions.

Termination of access does not automatically cancel subscriptions managed through a third-party application marketplace. Users remain responsible for cancelling active subscriptions through the applicable marketplace.

16. Children’s Use

The Service Provider does not knowingly collect personal information from children under the age of 13.

Users who are not legally able to consent to these Terms in their jurisdiction should use the Application only with the involvement and consent of a parent or legal guardian where required by applicable law.

Parents and guardians are encouraged to supervise children’s use of AI-powered services.

17. Changes to These Terms

We may update these Terms from time to time to reflect changes to the Application, third-party services, legal requirements, or our business practices.

The updated Terms will be made available through the Application or the location where these Terms are published, and the effective date will be updated accordingly.

Continued use of the Application following an update constitutes acceptance of the revised Terms to the extent permitted by applicable law.

18. Apple App Store Terms

If you download the Application through the Apple App Store, you acknowledge that these Terms are between you and IsmailApps LLC, and not Apple.

Apple is not responsible for the Application or its content, maintenance, support, or services except as required under Apple’s applicable terms.

Your use of the Application must also comply with applicable Apple Media Services Terms and Conditions and App Store rules.
